Terms of Service

Effective Date: 2025-11-30

These Terms of Service (“Terms”) govern your access to and use of the online livestock management platform (“Service”) provided by Pointr Solutions (Pty) Ltd.

By creating an account, logging in, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. User Accounts

Accurate Information: You agree to provide accurate, current, and complete information during registration.
Account Security: You are responsible for safeguarding your account credentials and for activities under your account.
Non-shareable Account: Your account is for your exclusive use and may not be sold, shared, or transferred.

2. Acceptable Use

You agree not to use the Service for unlawful purposes or in any way that violates these Terms.

Attempting to breach, scan, or test the vulnerability of the Service or related systems.
Uploading harmful code such as viruses or worms.
Sending unsolicited advertising or spam.
Interfering with the integrity or performance of the Service.

3. Payments and Subscriptions

Fees: Subscription fees are billed in advance and are non-refundable except as expressly stated in our policies.
Payment Failure: We may suspend access if payment is not successful within the grace period after notice.

4. Data, Privacy, and POPIA

Data Ownership: You retain ownership of the operational and livestock data you upload to the Service.
License to Use Data: You grant Pointr a limited license to host and process your data for operating and improving the Service and facilitating required traceability workflows.
Aggregated and Anonymized Data: Pointr may use anonymized and aggregated data for benchmarking, research, and product improvement.
Data Protection: Pointr processes personal information in accordance with POPIA and the Privacy Policy.

5. Service Availability

We use reasonable commercial efforts to keep the Service operational, but uninterrupted access is not guaranteed.

6. Termination

Termination by You: You may terminate the Terms by following the cancellation procedures.
Termination by Us: We may suspend or terminate access for material breach.
Data Handling: After termination, data may be retained for a short grace period before irreversible deletion.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind.

8. Limitation of Liability

To the maximum extent permitted by South African law, Pointr Solutions (Pty) Ltd and its personnel are not liable for indirect or consequential losses arising from your use of the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Pointr Solutions (Pty) Ltd against claims arising from your use of the Service or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and disputes will be brought in the courts of Cape Town.

11. Changes to Terms

We may modify these Terms from time to time. Continued use of the Service after notice of material changes constitutes acceptance of the updated Terms.
